Terms of Service
These terms are a binding agreement between you and {{LEGAL_ENTITY_NAME}} for your use of FandomFlow. Please read them carefully. By creating an account or using FandomFlow, you agree to them.
1. About these terms
FandomFlow is operated by {{LEGAL_ENTITY_NAME}}, {{REGISTERED_ADDRESS}} (“FandomFlow”, “we”, “us”). GSTIN: {{GSTIN}}.
“Service” means the FandomFlow website, web application, API, hosted stores and related services. “You” means the person or business that uses the Service. If you use FandomFlow for a business, you confirm you have authority to bind it to these terms.
2. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- Give accurate information, keep your password secure, and tell us promptly about any unauthorised use. You are responsible for activity in your account and workspaces, including by team members you invite.
- To connect Instagram you need a professional (Business or Creator) account and must comply with Instagram’s Terms of Use and Community Guidelines.
3. Plans, fees and payment
- FandomFlow offers a Free plan and paid plans described on our Pricing page. Plan limits (such as automations, monthly automated DMs, connected accounts and leads) apply per workspace.
- Paid plans are prepaid for one month in Indian rupees and are paid through Razorpay or PayU. A plan is activated after the payment is confirmed by the payment gateway.
- Plans do not renew automatically. If you do not renew, your workspace moves to the Free plan when the paid period ends.
- Prices are the total amount charged for the plan; if GST applies, it is included in the price shown.
- We may change prices with at least 30 days’ notice. Changes apply from your next purchase.
- Refunds are governed by our Refund & Cancellation Policy.
4. Acceptable use
You must not use FandomFlow to:
- send spam, unsolicited bulk messages, or messages to people who have not interacted with you, or otherwise breach Meta’s Platform Terms, Instagram’s policies or messaging rules;
- sell or promote illegal, counterfeit, dangerous or restricted goods and services, or anything prohibited by your payment gateway;
- harass, deceive or impersonate anyone, or infringe intellectual property or privacy rights;
- upload malware, probe or disrupt the Service, bypass limits, or access data that is not yours;
- resell the Service without our written permission.
We may remove content or suspend features that breach these rules.
5. Your store and your customers
- When you sell through a FandomFlow store, you are the seller and merchant of record. You are responsible for your products, descriptions, prices, taxes, invoices, delivery, returns, refunds and customer service, and for complying with consumer protection law, including the Consumer Protection (E-Commerce) Rules, 2020 where they apply.
- Your store must show your own accurate business details and policies (FandomFlow provides editable privacy, terms and refund pages).
- In direct payments mode, customers pay into your own Razorpay or PayU account. FandomFlow is not a party to your sales and does not hold your funds.
- You are responsible for having a lawful basis to message and process the data of your followers and customers.
6. Third-party services
FandomFlow works with services we don’t control, including Instagram (Meta), Razorpay, PayU and Cloudflare. Your use of them is subject to their own terms. If a third party changes or withdraws its API or service, some features may change or stop working, and we are not responsible for that.
7. Your content and our IP
You keep ownership of the content you put into FandomFlow. You grant us a limited licence to host, copy, process and display it only to provide and improve the Service for you.
FandomFlow, its software, design and trademarks belong to us. We grant you a limited, non-exclusive, non-transferable right to use the Service under these terms.
8. Availability and changes
We work hard to keep FandomFlow available and secure but do not guarantee it will be uninterrupted or error-free. We may improve, change or discontinue features. We will give reasonable notice of changes that materially reduce paid features.
9. Suspension and termination
You may stop using FandomFlow and delete your account at any time. We may suspend or terminate access if you breach these terms, create risk or legal exposure for us or others, or if required by law. Where reasonable, we will give notice and a chance to fix the issue. On termination, sections that by their nature should survive (such as liability limits and governing law) continue to apply.
10. Disclaimers
The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any level of sales, engagement or results.
11. Limitation of liability
To the extent permitted by law, FandomFlow is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the event giving rise to the claim.
12. Indemnity
You agree to indemnify FandomFlow against claims, losses and costs arising from your content, your store and sales, your messages to others, or your breach of these terms or of law.
13. Governing law and disputes
These terms are governed by the laws of India. Courts at {{JURISDICTION_CITY}} have exclusive jurisdiction, subject to any rights you have under consumer protection law. We encourage you to contact us first so we can try to resolve any issue informally.
14. Changes to these terms
We may update these terms. We will post the new version here and notify you of material changes by email or in the app. Continuing to use FandomFlow after changes take effect means you accept them.
